TERMS AND CONDITIONS OF GUIDED WALKING TOURS IN GDAŃSK

hereinafter referred to as the “Organizer”.
1. General provisions

These Terms and Conditions define the rules for providing guided walking tours and participation in walking tours organized by the Organizer.

These Terms and Conditions specify the rights and obligations of the Organizer and persons participating in the tours, hereinafter referred to as the “Participants”.

Booking a tour means that the Participant has read and accepted these Terms and Conditions.
-
The services provided by the Organizer include organizing and conducting guided walking tours in Gdańsk according to the offer presented on the website, promotional materials, or individual arrangements with the customer.
-
The service provided by the Organizer consists of guiding and conducting walking tours. Unless explicitly stated otherwise, the service does not include transportation, entrance tickets, meals, or other additional services.
2. Types of tours

The Organizer provides:
a) regular group walking tours – available for all interested persons according to the published schedule,
b) private and individual tours – prepared according to individual customer requests.

Each tour may include information regarding:

tour description,
-
route,
-
duration,
-
price,
-
maximum number of participants,
-
meeting point,
-
ending point.
-
The meeting point and ending point may differ depending on the selected route and will be specified in the tour description or booking confirmation.
3. Private and individual tours

The Organizer may provide private tours, the details of which may differ from the standard offer available on the website.

For private tours, the following details may be agreed individually:

date,
-
starting time,
-
route,
-
duration,
-
number of participants,
-
theme of the tour,
-
price,
-
additional customer requests.

Individual arrangements may be made via:
-
e-mail,
-
telephone,
-
messaging applications,
-
other communication channels agreed between the Organizer and the customer.

Individual arrangements confirmed between the Organizer and the customer form the basis for providing the specific service.
4. Booking a tour
-
A tour can be booked through:
-
the booking form available on the Organizer’s website,
-
an online booking system, if available,
-
direct contact with the Organizer.
-
The booking form may be operated using external online tools, such as Google Forms.
-
The Participant is required to provide accurate and current information necessary to provide the service.
-
Providing incorrect contact details, especially an incorrect e-mail address or phone number, may prevent effective communication. The Organizer is not responsible for consequences resulting from incorrect information provided by the Participant.
-
A booking is considered confirmed after meeting the conditions specified for the selected tour, including payment if required.
-
Booking confirmation is sent to the e-mail address provided by the Participant or through another agreed communication channel.
5. Participants and age requirements
-
Participants are required to provide information necessary for completing the booking.
-
Adults may participate in the tours.
-
Persons aged 16 or older may participate independently provided they have the consent of a parent or legal guardian.
-
Persons under 16 years of age may participate only when accompanied by an adult.
-
A parent or legal guardian is responsible for the safety and behaviour of a minor under their care.
-
The Organizer does not provide individual supervision of children participating in tours.
6. Prices and payments
-
The price of each tour is provided in the relevant offer.
-
All prices provided by the Organizer are gross prices.
-
Payments can be made using the payment methods available from the Organizer.
-
If online payments are available, payment processing may be handled by external payment providers.
-
Upon request, the Organizer may issue a proof of purchase or invoice in accordance with applicable regulations.
7. Cancellation by the Participant
-
The Participant may cancel participation in the tour free of charge up to 24 hours before the scheduled start time of the tour.
-
If the cancellation is made less than 24 hours before the start of the tour, the Organizer has the right to charge a cancellation fee of 50% of the booking value.
-
If the Participant does not appear at the meeting point and has not contacted the Organizer beforehand, the payment is non-refundable.

The Participant should inform the Organizer about cancellation as soon as possible by:
-

telephone,
-
available messaging applications.
-
Changing the tour date may be possible after prior contact with the Organizer and depends on availability.
8. Refunds
-
Refunds are processed according to the rules specified in these Terms and Conditions.

In case of a valid cancellation by the Participant:
a) cancellation up to 24 hours before the tour – the Participant is entitled to a 100% refund,
b) cancellation less than 24 hours before the tour – the Organizer may retain 50% of the booking value.

In case of failure to attend the tour without prior contact, the payment is non-refundable.

If the Organizer cancels the tour, the Participant may choose:
-
participation on another available date,
or -
a full refund of the amount paid.

Refunds are made using the same payment method used for the original transaction unless otherwise agreed.
9. Minimum number of participants
-
The Organizer may set a minimum number of participants required for a tour to take place.
-
The minimum number of participants for standard group tours is 2 people, unless stated otherwise in the description of a specific tour.
-
If the minimum number of participants is not reached, the Organizer may:
-
cancel the tour,
-
offer another available date,
-
propose another form of service.
-
If the Organizer cancels the tour due to insufficient participants, the Participant will receive a full refund.
-
The minimum number of participants does not apply to private tours, for which conditions are agreed individually.
10. Cancellation by the Organizer
-
The Organizer may cancel a tour before its start if providing the service is impossible or could pose a risk to Participants.
-
Reasons for cancellation may include:
-
dangerous weather conditions,
-
storms,
-
strong winds,
-
heavy rainfall,
-
extreme temperatures,
-
safety risks along the route,
-
decisions of public authorities or emergency services,
-
other circumstances beyond the Organizer’s control.
-
The Organizer makes decisions regarding cancellation primarily based on Participants’ safety.
-
Information about cancellation will be provided to Participants as soon as possible using available contact details.
11. Weather conditions
-
Walking tours take place regardless of normal weather conditions if the Organizer considers participation safe.
-
Participants should prepare appropriately for current weather conditions, including:
-
suitable footwear,
-
rain protection when necessary,
-
sun protection,
-
sufficient water.
-
Normal weather conditions such as rain, cold temperatures, or wind are not automatically grounds for a refund if the tour takes place as planned.
-
The Organizer may cancel a tour before departure if weather conditions may endanger Participants.
12. Changes to the route and circumstances beyond the Organizer’s control
-
The Organizer reserves the right to make minor changes to the tour route or schedule.
-
Changes may result from:
-
construction works,
-
street closures,
-
city events,
-
concerts,
-
public gatherings,
-
restricted access to certain locations,
-
decisions of authorities,
-
other circumstances beyond the Organizer’s control.
-
The Organizer may change the order of visited locations or use an alternative route.
-
Such changes do not constitute grounds for complaints or refunds if they do not significantly affect the character and value of the tour.
13. Participant safety
-
Participants must follow the guide’s instructions regarding safety and organization of the tour.
-
Participants should consider their own physical condition and ability to complete the planned walking route.
-
Participants should inform the Organizer about important circumstances that may affect safe participation if necessary.
-
Participants must exercise caution when moving through public areas, especially:
-
pedestrian crossings,
-
areas with traffic,
-
crowded tourist locations,
-
uneven surfaces.
-
The Organizer is not responsible for incidents resulting from failure to follow safety instructions or the guide’s recommendations.
14. Participant behaviour
-
Participants must behave respectfully towards the guide, other Participants, and members of the public.
-
The Organizer may refuse participation or remove a Participant from the tour if their behaviour:
-
threatens safety,
-
disrupts the tour,
-
prevents proper service delivery,
-
violates applicable laws or good manners.
-
In such cases, the Participant is not entitled to a refund.
15. Alcohol and intoxicating substances
-
Participants must take part in the tour in a condition that allows safe participation.
-
The Organizer may refuse participation to persons who:
-
are under the influence of alcohol,
-
are under the influence of drugs or substances affecting safe participation,
-
behave in a way that creates a safety risk.
-
In such cases, the payment is non-refundable.
16. Photos and use of image
-
The Organizer may take photographs and recordings during tours for documentation and promotional purposes.
-
Publication of materials containing an identifiable image of a Participant takes place only with the Participant’s voluntary consent.
-
Refusing consent does not affect the possibility of participating in the tour.
-
Materials may include:
-
locations,
-
monuments,
-
routes,
-
groups of Participants where individuals cannot be identified.
17. Personal data protection
-
Participants’ personal data is processed in accordance with applicable data protection regulations, including GDPR.

Detailed information regarding:
-
the data controller,
-
purposes of processing,
-
scope of collected data,
-
storage period,
-
Participants’ rights,
is available in the Privacy Policy published on the Organizer’s website.
18. Complaints
-
Complaints regarding the service may be submitted to:

A complaint should include:
-
name and surname,
-
contact details,
-
description of the issue,
-
booking details (if applicable).
-
The Organizer will review complaints within a reasonable time and provide a response.
19. Right of withdrawal
-
For services related to leisure activities provided on a specific date or within a specific period, the right of withdrawal may not apply in cases provided by applicable law.
20. Final provisions
-
These Terms and Conditions enter into force on the date of publication on the Organizer’s website.

The Organizer reserves the right to update these Terms and Conditions due to legal, organizational, or service changes.

The current version of these Terms and Conditions is available on the Organizer’s website.
-
Matters not regulated by these Terms and Conditions are governed by Polish law.
